Corrine Roe 1,012 words Art 100 4/8/12 Aesthetics Learning Object The first two pictures that are being compared are Shirin Neshatb â€Å"Allegience with Wakefulness† 1994 and Jasper Johns â€Å"Three Flags† 1958. In the â€Å"Allegience with Wakefulness† is instrumentalist. It is instrumentalist because it is the writing on this person’s feet is not English and there is a gun between the person’s feet. This might be taken as things that are different from what we are used to be taken as threat.American people in general have a closed minded way of looking at things. The other aesthetic perspective for this art piece that are noted is linguistic. Linguistic are has symbols as well and the gun could also be seen as a symbol. It has words written in it too specifically on the feet. This artistic piece is powerful because it can have so many meanings to it and can mean many things to many different people. â€Å"Three Flags† is a linguistic pai nting. It is obvious that this is a linguistic painting because it is the American flag. The American flag is tied strongly to American culture.It is a symbol of our freedom. Imitationist is the next aesthetic perspective that is seen in this paper, obviously because it looks just like the American flag. The American flag looks like it is popping of the page because of the way they get smaller as they move forward. Both of these art pieces have a strong message behind them. The first one, â€Å"Allegience with Wakefulness† has a language in it that most Americans would not be able to understand. It also has a gun which could mean a lot of different things in this particular picture. The second picture â€Å"Three Flags† is pretty much the opposite of that.It is very recognizable for everyone in the American culture. It stands for freedom our freedom. The next two paintings that are compared are â€Å"Mystic Package† by Claudio Bravo in 1967 and â€Å"Rabbitâ₠¬  by Jeff Koons in 1986. The â€Å"Mystic Package† is an imitationist piece of art. It is imitationist because it looks like a regular package that could see pretty much anywhere. This art piece could also be known as linguistic. It is a linguistic aesthetic because it has strong social ties to our everyday lives. Most people get gifts in packages or important thing they have ordered or thing they bought just for fun.We usually associate a package with a good thing. The â€Å"Mystic Package† has a special hyper-realistic quality about it that makes look like it is an actual package. â€Å"Rabbit† is formalist piece of art. It is formalist because it has a modern design. It almost looks robotic and has a futuristic quality about it. The artist pays extra attention to the shape and details like the rabbit’s ears and how the rabbit is holding a carrot. This art piece could also be known as expressionist. When people see rabbits they often think of pets tha t they have had or think of rabbits hoping threw the forest.People usually have happy feelings when it comes to rabbits and other animals. In the art piece â€Å"Mystic Package† it is something we see all of the time. It’s a common package that we use to ship things. In the â€Å"Rabbit† art piece it is the exact opposite. It is something that we do not normally see. We see rabbits but not in shiny balloon form. It looks like a robot more than anything. That is why it is so futuristic looking. In conclusion art has a lot of different aesthetic perspectives. Art is unique in its own way and makes a different impression on everyone who sees it.Someone may disagree with the aesthetic perspectives that are above but they seem to make the most sense. When you use instrumentalist to describe a piece of art that is used to make people think and have a purpose behind them. Linguistic is art tied to culture and has symbolism. Imitationist art is tied to something that ac tually exists in everyday life. Formalist art is that focuses on texture, color, shape and modernism. Expressionist evokes feelings. Usually things in the art make you feel happy or sad or mad or something like that. Aesthetic perspectives change with every person.Not everyone feels or thinks the same way we they look at a piece of art. Things mean different things to different people. Like someone from another country would not have such a close tie with the art with the American flag in it. Someone who understands the language written on that persons feel might feel something different when they look at the picture then someone who cannot read it. Being able to understand what is written might help the picture make the picture mean something totally different than what someone else gets out of it.The art with the package might mean something totally different from one person to the other. They might not even understand how some people get what they get out of it. The picture with the shiny rabbit might not seem futuristic to one person like it does for another. One person could totally not even understand how one person sees something from a piece of art. When something is imitationist usually everyone who sees the painting can understand why it is that way. Usually it is something that people commonly see in everyday life, unless someone has not seen that object in their life.People experience different things in their live and that can influence what they see or feel from a piece of art. Sometimes people see something that other people do not understand but that is their perspective and no one can really tell them that they are wrong. It is all about your experiences and no one can tell that what you are seeing is wrong because art is interpreted by the people seeing it. Some people have experienced things that other people have not so they can look at things in different ways than others.

There are two primary grounds of appeal.   The first ground is founded on principles of adverse possession.   It can be successfully argued that adverse possession by definition and application does not arise in this case since it was always the title owners intention that A live on the property.   The second ground of appeal is founded on principles of constructive trusts in which case it can be argued that permitting A to acquire legal title to the trust property is and was contrary to the parties’ intentions.Adverse PossessionMr. Nicholas Strauss QC erred in finding that A acquired title by virtue of the doctrine of adverse possession.   The doctrine of adverse possession requires more than a mere 12 years of undisturbed possession.   As Lord Browne-Wilkinson   explained in J.A. Pye (Oxford) Ltd. and Others v Graham and Another [2003]:â€Å"The question is simply whether the defendant squatter has dispossessed the paper owner by going into ordinary possession o f the land for the requisite period without the consent of the owner.† (J.A. Pye (Oxford) Ltd. and Others v Graham and Another [2003] 1 AC 419)In appears from the ruling in Martin v Myers that Mr. Nicholas Strauss QC took a purely one-sided view of possession. (Martin v Myers [2004] EWHC 194)   For the purposes of the doctrine of adverse possession, possession is required to contain two elements.   Those elements are factual possession and an intention to possess. Slade J in Powell v McFarlane (1977) described factual possession as the exclusive occupation of the land to the extent that a true owner is otherwise entitled to occupy it. Slade J went on to explain that:â€Å"The question what acts constitute a sufficient degree of exclusive physical control must depend on the circumstances, in particular the nature of the land and the manner in which the land of that nature is commonly used or enjoyed.† (Powell v McFarlane (1977) 38 P&CR 452 at 470)Obviously, A’ s possession of the home purchased by E was not intended to dispossess E, an essential element of adverse possession. As it happened, E purchased the property intending for it to be occupied by both he and A and their seven children. Therefore upon his passing, his intentions would have continued and had he not disposed of the property by will it would have and should have devolved by the laws of intestacy. (Administration of Estates Act 1925, Part II)   Certainly he must have intended for A to remain in the â€Å"matrimonial home† until such time as she passed on.   Therefore there could not have been any acquisition of title upon his death by virtue of the doctrine of adverse possession.   A’s possession of the â€Å"matrimonial home† was merely consistent with E’s intention upon the purchase of the home.In disposing of property under Part II of the Administration of Estates Act 1925 the â€Å"matrimonial home† would have been divided among the next of kin. (Administration of Estates Act, 1925)   In this case, since A and E were not wed, the children are the next-of-kin. The home was purchased specifically for the purpose of providing a home for A, E and their children and it is certainly within E’s intention that A should remain in the â€Å"matrimonial home† until such time as she passed on.   The children, who are the appellants in this case, acting in a manner consistent with E, the paper owner’s intention did not insist that A deliver vacant possession upon E’s death.   It would appear to be contrary to principles of equity to interpret their well-meaning conduct against them in a purely technical sense.Aware that there was a constructive trust which provided for A to remain in possession of the â€Å"matrimonial home† the appellants were merely honouring their father’s wishes.   A, on the other hand, by passing the home on to her son P was acting against Eâ€℠¢s intentions and against the spirit and intent of the constructive trust.   When one considers the implications of a constructive trust, it becomes clear that Mr. Nicholas Strauss QC erred on both equitable and common law principles.Constructive TrustsA constructive trust is imposed upon the paper owner of realty in circumstances where it is commonly understood that the property is held for the benefit of the owner and others. (Gissing v Gissing. [1971] AC 886)   In the Martin case there is no question that E held the paper for the benefit of himself, A and their seven children, four of whom are the appellants.   As Lord Justice Dillon said in Springette v Defoe [1992] 2 FLR 388:â€Å"†¦the common intention of the parties must, in my judgment, mean a shared intention communicated between them. It cannot mean an intention which each happened to have in his or her, own mind but had never communicated to the other.† (Springette v Defoe [1992] 2 FLR 388 at p. 393)It i s assumed based on the facts of the Martin case that both A and E intended that the â€Å"matrimonial home† be held upon trust for themselves and their children.   As a result, the children’s interest in the home would not arise until such time as both A and E had died.   Therefore it would be contrary to the intention of the trust as created by E to allow for the children’s interest in the home to arise during A’s lifetime. Therefore the Limitations Act, 1980 could not start to run during A’s lifetime, as she was entitled to remain in the matrimonial home during her lifetime.   Likewise, the appellants’ interest in the matrimonial home did not arise until such time as both A and E had died.The common intentions of the parties is essentially what gives rise to a constructive trust. (Walker v Hall FLR 126) A, by leaving the property to her son P was acting in a manner inconsistent with the trust.   In any event, all that P could do wa s hold the property as trustee for the remaining children and himself as beneficiaries of the trust.   Since it is clear that the property is subject to a constructive trust the Trusts of Land and Appointment of Trustees Act 1996 will apply. (Trusts of Land and Appointment of Trustees Act 1996)By virtue of Section 3 of the Trusts of Land and Appointment of Trustees Act 1996 the appellants have an interest in the property as well as the proceeds of sale. (Trusts of Land and Appointment of Trustees Act 1996, Section 3)  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Another issue that can be argued on appeal is that the home, which was trust property was sold contrary to Section 11 of the Trusts of Land and Appointment of Trustees Act 1996.   By virtue of Section 11, a trustee may not sell the real estate which is trust property without first obtaining the consent of the beneficiaries under the trust.(Trust of Land and Appointment of Trustees Act 1996, Section 11)The courts when called upon to make an or der for sale or otherwise of the property are required to look at the purpose for which the trust was set up in the first place.   Ã‚  Ã‚   .(Trust of Land and Appointment of Trustees Act 1996, Section 13)   It therefore follows that had the appellants attempted to dispossess A following E’s death they would have been barred by virtue of Section 13 of the Trust of Land and Appointment of Trustees Act 1996 since the property was purchased as a â€Å"matrimonial home† for A, E and their seven children.A’s interest in the matrimonial home is equitable in nature for two reasons.   E purchased the house for both he and A and their seven children.   Her interests together with the children’s interest will be determined by the equitable principles applicable to constructive trusts.   A’s second interest in the property arises out of the fact that she was an occupier of the property under the terms of the constructive trust.   Therefore A could not have dispossessed the appellant’s equitable interests in the matrimonial home by the operation of the Limitations Act 1980. (Smith, 2006)ConclusionA’s occupation of the matrimonial home until her death or until she chose to leave was subject to a constructive trust.   As a beneficiary under the constructive trust she was not dispossessing other beneficiaries under the trust by occupying the matrimonial home.   Therefore the statutory period for the acquisition of title by virtue of the doctrine of adverse possession could not have begun to run and neither could it arise to bar the equitable interests of the other beneficiaries under the trust.Moreover, even if one were to look beyond the operation of the constructive trust principles,   E had always intended for A and the children to remain in the matrimonial home.   Therefore upon his death, the appellants, by failing to claim an interest in the property were merely honouring their father’s wishes.    Wishes he clearly communicated when he purchased the home.   The mere fact that A were permitted to remain in the matrimonial home by the consent of the proper heirs to E’s property since E was not married to E and would not inherit under the laws of intestacy is a bar to any claim under the doctrine of adverse possession.As a result of the application of the legal principles there are two possible approaches to the appeal.   First it can be claimed that the matrimonial home was subject to a constructive trust which gave A the right to remain in the matrimonial home until her death, subject to the beneficial interests of the children.   Secondly it can be argued in the alternative, that E always intended for A to remain in the matrimonial home until her death therefore she could not have acquired title by virtue of adverse possession by occupying the house as long as she did.ReferencesAdministration of Estates Act 1925Gissing v Gissing. Though at times he adopts the Petrarchan devices, yet his imagery and rhythm, texture and color of his love poetry is different. There are three distinct strains of his love poetry – Cynical, Platonic and Conjugal love. The Sun Rising is one of Donne’s popular and widely read love poems. It is love poem of an unusual kind. In this poem the poet lover reprimands the Sun and calls it names for disturbing love making. Here as a lover Donne exaggerates his love and his beloved so much that it overlaps the Petrarchan love poetry also. He addresses the Sun as â€Å"busy old fool†. He calls it unruly because, by peeping in to the bedroom through windows and curtains it disturbs the lovers. The poet-lover tells the Sun that lovers’ seasons do not run to its motions. It is not affected by time. The poet’s wit is so clear when he tells the Sun that he has no reason to think that his beams are â€Å"so reverend and strong†. The poet lover could eclipse and could the beams of the Sun with a wink. He does not do so because he does not wish to â€Å"loose her right so long.† He says Thy beams so reverend and strong Why shouldst thou think? I could eclipse and cloud them with a wink. But that I would not lose her sight so long. The poet-lover knows that the Sun would go to the other half of the world and come to that place at this time tomorrow. The poet-lover asks the Sun to go round the world, see all Kings, come back tomorrow and say if â€Å"both the India’s of spice and mine† . He says to leave them alone and to let them love. Again, he says, his beloved is represents the whole world, East Indies and the West indies because of her sweet fragrance and her glitter. Here Donne uses highly hyperbolical words for her beloved. He says again that his beloved is all the states and he is the prince of this state, nothing else matter to him, and nothing else exist for him, except he and his beloved. She is all the state, and all princes I Nothing else is. Furthermore, compared to their love all â€Å"honour’s mimick†, all wealth alchemy.† In the latter imagery there is an allusion to the medieval belief in the powers of magic etc. In this particular poem Donne’s praise for his beloved reaches at the height that is incomparable to nothing. However, we find the opposite side of the coin in the poem namely ‘Go and Catch a Falling Star’. Here we find Donne’s duplicity as a lover. In ‘The Sun Rising’ we find Donne passionate and sensuous as a lover, but in Go and Catch a Falling Star he is very much cynical as a lover. He does not believe in true love. We find Donne’s misogynistic attitude here. The poem starts by challenging to catch a falling star. The falling star can signify something bright and beautiful that has come to an end and how difficult it is hold on to this goodness for ever. It also suggests trying and making a wish and seeing if it comes true. In fact it is as difficult to catch a falling star as it is to get with child a mandrake root which shows the stark contrast of getting a child which is something innocent and joyous to a mandrake root which is used in witchcraft to wish death on someone. Again the contrast of living and the positive is contrasted with death and negativity. Donne here presents many impossible tasks and says to find a true woman is as impossible as the tasks are. He says it is impossible to remember the past years, to listen the mermaid song, and to find the person who clove the Devil’s foot. According to Donne, it is impossible to find; a loyal and chaste woman. The poet, through irony and exaggeration suggests the impossibility of the undertaking to discover a true and fair woman. According to him And swear No where Lives a woman true, and fair. He believes fair women will have lovers and therefore it is not possible for them to be faithful to any of them. If anyone ever found then Though she were true when you met her, And last till you write your letter, Yet she Will be False, ere I come, to two, or three. To him to find a true and fair woman is not a herculean task rather it is impossible. Here we find the duplicity of Donne. He is here misogynist and believes true love cannot be found because of women’s fickleness. Women are inconsistent and for that reason true love cannot be found, as a woman use to love so many suitors. He criticizes the women race and spares no words to ridicule them. Here his misogynistic attitude shows that he has very little respect for love. In ‘The Sun Rising’ we find him as a pure lover, who believes in solely love. He praises his beloved and the placed her with the Olympian goddesses. He same Donne in ‘Go and Catch a Falling Star’ shows abominable attitude towards love and towards women race. He skeptically believes that women are neither deities nor fully honest; they possess all the human shortcomings. Thus Donne’s attitude towards women is materialistic, pessimistic, and occasionally misogynistic. This contradictory attitude as a lover makes him unique. Analysis of Clients objectives will be evaluated to provide a better understanding on the project issues and main concerns, which includes an analysis of the various procurement routes such as the Traditional Route, the Design Build Route and the Management Route to weigh the most suitable route to suit the Clients objectives. The report will allow the Client to make a better choice in selecting the best procurement route based on the recommendations discussed. This includes the advantages, disadvantages and risks involved for the 3 main procurement routes based on Clients objectives. It will identify issues on the project requirements on quality, time and costs ensuring the Clients objectives are met. INTRODUCTION The Client owns a large chain of hotels called Cinnamon Grand. The hotels provide guests with comfortable accommodation throughout the UK. Their main business includes adopting neglected historical landmarks and refurbishes the building to their former magnificent look. Although the Client is experienced at renovation of historical buildings, the Client does not have much experience in re-constructing damaged buildings or alteration works to the structures of the building. The project objective is to re-construct 3 Hotels, damaged by a period of bad weather and severe storms to an existing hotel quality or better. These Hotels are located in prime locations in town settings which means time is of the essence. For phase 1, time is the main priority due to the prime locations of the hotels. The opportunity cost will be incurred if there are any delays in phase 1. For phase 2, issues raised are the quality of the facilities and to ensure there is none or minimal disruption to the business. As the Consultant to the Client, we will discuss the 3 main procurement routes which are the Traditional Route, the Design Build Route and the Management Route and analyse the best route based on the Clients objective. CLIENTS OBJECTIVES Client is concern about the duration of the project and its quality. Internal facilities must be upgraded and reconstruction of building must preserve the historical outlook of the existing building. Although the Client has experience in renovation works, the current project development includes the demolition of structures and re-construction of hotels both external and internally. Projects done by Client previously is different in nature, one being renovation works, minor construction works and current is a complex re-construction and refurbishment of the damaged hotels. The project consists of 2 (two) phases:- Phase 1 is to re-construct the hotels outlook and structures and completing key areas for operation which are the Roofs, Guest Rooms, Restaurant and Swimming Pools. Expected date of possession of site by contractor is 1st Mar 2014 and expected construction completion date is 28th February 2015, a 1 year construction. Planned re-opening on 1st April 2015. Phase 2 is to enhance the hotels with new facilities such as Dance Studios, Health Fitness Centre, Conference and Meeting Rooms without any disruption to hotel operations. The Client is very concern about the duration of the project due to the location, a prime town setting which means, if the hotels completes early, the losses incur from no business days or opportunity cost will be lesser. The second concern is the quality of the building. Outlook must be the same as before being damaged, structurally must be improved to increase building total life cycle. While time and quality is of the main concern, the cost of the project must not exceed the budget of $120 million pounds for total of 3 hotels. The cost certainty must be known earliest possible. PROCUREMENT ISSUES The procurement issues are listed below:- No in-house executive by the client, means the Client have to engage consultants to oversee the project. Highly concerned about possible project delays and overrun of costs. Financial loan of $120 million pounds acquired for project. This means there is a tight budget, so cost certainty is required before the construction begins. Works in phase 2 must be done quickly to minimise the discomfort to guests. Quality of building should be high and sensitive to ensure the dignity of the building and services provided are not compromise. Every procurement route have its main priorities, no procurement can accommodate to the three main factors which are Time, Cost and Quality. PROCUREMENT ROUTES Traditional route: in this route the Client appoints a team of consultants to design and prepare tender documents. The process is in sequence as shown in Fig 1. The selection of a main contractor is done later through tendering. Fig 1 Advantages are the competitive tendering, low preparation cost for tendering, procedures are known widely and variations are easily arranged. Disadvantages are mainly the long timeline, no concurrent work at site, incomplete design results in less certainty, poor build-ability due to contractor not involved during design stage, risk by Client for the design. Risks on cost are low due to lump sum contract and there is a fixed contract date with exception that contractor claims extensions. Since the design is designed by the consultants, there is low design and quality risk. Although the Traditional route is sequential, there are 2 other variations. They are the traditional accelerated and traditional with re-measurement. For the Traditional accelerated, the contractor is appointed earlier based on partial design and brief through negotiation or competitive tendering. Traditional routes focus on the cost and the quality of the project. In this case, for the current project, time is of the essence. Traditional route is not suitable for the project. Design and Build route: in this route a main contractor is appointed to design and construct the project. This route integrates design and construction which means, the construction works are concurrent even before final design is completed as shown in Fig 2. This quickens the timeline of the project. Fig 2 Advantages of this route are the client liaises with a single point of communication and responsibility. The price certainty is known before the construction starts. The total project duration is shorter than in the traditional route as works are done concurrently with design. Disadvantages are there is no design overview because it is designed by the contractor. The design brief by client must be adequate and the bid through tender is difficult to compare. Changes made by client can be expensive. Risk on cost and time are low as it will be on a lump sum basis and works are done to a fix time. There is a high risk in design and quality as the contractor controls the design and some contractors do not have the capacity to carry out the proper design. Although the design is mostly done by contractor, variants such as Develop construct can be considered to improve design. In develop construct route the employer appoints a consultant at the initial stage to develop a detailed design to have more control on the design. Assuming the Client have the detailed design drawing for the existing building, this option is the most suitable for the project. Management route: this route consists of 2 variant, The Management Contracting and The Construction Management route. In this route, the Client appoints the Management Contractor at an early stage where they help to design and contribute management expertise. The appointments of sub-contractors/specialist contractor are decided by both the Client and Management Contractor before work commencement in packages, as shown in Fig 3. Fig 3 Advantages are the work packages of specialist contractors are competitive, due to the concurrent works, timeline will be quickened. Late changes can easily be accommodated and the relationship between the Client and the Management Contractor is much closer than in traditional. Disadvantages are the cost prediction, the need for a good project team and a quality brief. The design must be managed properly to ensure work packages is kept on programme. Risks are low for design and quality due to close link between client and contractor but medium risk for cost and time as the amount is known after the last package is let. This route is longer compared to design and build and require a good history between client and contractor. RECOMMENDATIONS Based on the Clients objectives, the Design Build variant (Develop Construct) is the most suitable for the project. This procurement route does not need an in-house executive as a consultant will be in-charge of developing the design of the project. Assuming Client has the design of the existing 3 hotels, the design for the structure is acquired and project can commence as early as a contractor is appointed, shorter timeline. The cost of the project will be known before the work commences and the quality of building will not be compromise due to existing design by Client and additional inputs by the design team for the phase 2 of the project. The quality of phase 2 will be based on design worked by the Client specifications and the design team, ensuring good quality facilities.
